Restricted Jurisdictions

1. Purpose of this page
This page explains where Finotive.com, the Finotive One account, and services provided by Finotive group entities may be restricted or unavailable.
Restrictions may be based on law, regulation, sanctions, regulatory permissions, payment-provider rules, platform-provider rules, banking rules, product design, internal risk controls, fraud-prevention requirements, tax requirements, or compliance policy.
2. General restriction
This website and the services of Finotive group entities are not directed at, and are not intended for distribution to or use by, any person in any country, territory, or jurisdiction where such access, distribution, or use would be contrary to local law or regulation.
You must not access, create an account, complete onboarding, use a service, make a payment, receive a payout, or use a Finotive platform if doing so would be unlawful or prohibited for you.
3. Restricted persons
Finotive may restrict or refuse access to:
- residents of restricted jurisdictions;
- citizens or nationals where restrictions apply by law, regulation, sanctions, or product policy;
- persons located in restricted jurisdictions;
- persons ordinarily operating from restricted jurisdictions;
- persons using VPNs, proxies, remote access, or technical methods to conceal location or identity;
- sanctioned persons, blocked persons, PEPs where prohibited, or persons connected with sanctioned activity;
- persons who fail KYC, AML, sanctions, fraud, payment, tax, or eligibility checks;
- persons who provide false, misleading, incomplete, or inconsistent information; and
- persons otherwise restricted by law, regulation, payment-provider requirements, platform-provider requirements, banking requirements, or internal compliance policy.
4. Restricted jurisdictions list
Access may be restricted for residents, citizens where legally restricted, persons located in, or persons ordinarily operating from the following jurisdictions, territories, and regions:
- United States of America;
- Canada;
- Belgium;
- Japan;
- Cuba;
- Iran;
- North Korea, officially the Democratic People's Republic of Korea;
- Syria;
- Russia;
- Belarus;
- Crimea;
- Sevastopol;
- Donetsk;
- Luhansk; and
- any jurisdiction, territory, region, person, or entity subject to applicable sanctions, embargoes, regulatory restrictions, payment-provider restrictions, platform-provider restrictions, banking restrictions, or internal compliance restrictions.
This list is not exhaustive and may change at any time without prior notice. Product-specific restricted-jurisdiction lists may be stricter or different. If a product-specific list is stricter, the stricter restriction applies.
5. User representations
By accessing Finotive.com, creating a Finotive One account, completing onboarding, making a payment, receiving a payout, or using any Finotive service, you represent and warrant that:
- you are not located in a restricted jurisdiction;
- you are not resident in a restricted jurisdiction;
- you are not a citizen or national of a restricted jurisdiction where access is legally restricted or prohibited;
- you are not subject to sanctions or other legal restrictions that prohibit access;
- your access and use complies with all laws and regulations applicable to you;
- you will not use VPNs, proxies, remote access tools, false documents, false addresses, or other methods to bypass restrictions; and
- all information you provide to Finotive is accurate, complete, and up to date.
6. Monitoring and enforcement
Finotive One Limited and relevant Finotive group entities may use KYC checks, IP checks, device checks, document checks, payment checks, geolocation indicators, sanctions screening, fraud-screening tools, and manual review to assess jurisdictional eligibility.
Finotive may refuse onboarding, restrict access, suspend accounts, terminate services, cancel transactions, withhold or review payouts, reverse payments, request additional information, or take other action where required or considered appropriate for legal, regulatory, sanctions, payment, fraud-prevention, risk-management, or compliance reasons.
7. No circumvention
You must not attempt to bypass restricted-jurisdiction controls. Circumvention may result in account closure, service termination, loss of access, payout refusal, reporting to relevant providers or authorities, and other remedies available under applicable terms and law.
